1. About these Terms

These Terms & Conditions govern access to and use of the RAYLAV Nyumbani property marketplace, including:

  • properties.raylav.net;

  • findyourehome.co.ke;

  • fyh.co.ke;

  • related customer portals, property-listing forms and marketplace services.

RAYLAV Nyumbani is a branch mark operated by RAYLAV Property Management Ltd. In these Terms, “RAYLAV”, “we”, “us” and “our” refer to RAYLAV Property Management Ltd. “Platform” refers to the RAYLAV Nyumbani website and related services.

By visiting the Platform, creating an account, submitting a property, purchasing a listing package, sending an enquiry or otherwise using our services, you agree to these Terms.

If you do not agree, you must not use the Platform.

2. Eligibility and authority

You must be at least 18 years old and legally capable of entering into binding agreements to use transactional features of the Platform.

If you use the Platform for a company, partnership, property owner, developer, estate agency or other organisation, you confirm that you have authority to act on its behalf.

Estate agents, developers, property managers and other representatives must ensure that they are properly authorised and satisfy any registration, licensing or professional requirements applicable to their activities.

3. Nature of the Platform

RAYLAV Nyumbani provides a digital property marketplace through which:

  • property owners and authorised representatives can advertise properties;

  • tenants and buyers can discover available properties;

  • visitors can send enquiries and request viewings;

  • owners can purchase Bronze, Silver, Gold or other listing packages;

  • RAYLAV can review property submissions before publication.

Unless expressly agreed otherwise in writing, RAYLAV provides advertising, communication and introduction tools. RAYLAV is not automatically a party to a sale, tenancy, lease, deposit, financing arrangement or other transaction between Platform users.

No property is purchased or rented through the Platform’s shopping cart. Shopping-cart and checkout functions are intended for listing packages and related RAYLAV services only.

Where a property is specifically identified as managed by RAYLAV, or where separate property-management, tenant-placement, inspection, collection, negotiation or agency services are requested, those services may be governed by an additional written agreement. If there is a conflict, the specific service agreement will prevail for those services.

4. Property information and marketplace limitations

Property descriptions, prices, availability, photographs, videos, locations, amenities and other listing information are generally supplied by property owners or their authorised representatives.

RAYLAV may review, format, moderate or request clarification of submitted information. However, publication or review does not constitute a guarantee that:

  • every statement is complete or accurate;

  • the property remains available;

  • the advertiser owns the property;

  • the advertiser has authority to sell or let it;

  • permits, titles or approvals are valid;

  • the property is suitable for a particular purpose;

  • the advertised price will remain unchanged;

  • a transaction will be completed.

Visitors must conduct their own enquiries and due diligence before making a decision or payment.

You should inspect the property, confirm the advertiser’s identity and authority, verify ownership or title information where appropriate, and obtain independent legal, financial, valuation, survey or professional advice.

Never transfer a deposit, rent, purchase price or other property-related payment merely because a listing appears on the Platform.

5. Accounts and account security

Certain features require a registered account.

You agree to:

  • provide accurate and current account information;

  • keep your password and access credentials confidential;

  • notify RAYLAV promptly if you suspect unauthorised access;

  • accept responsibility for activity conducted through your account, except where caused by RAYLAV’s failure to use reasonable security measures;

  • use only accounts and property listings you are authorised to manage.

RAYLAV may require identity, ownership, authority or contact verification before allowing access to certain features or publishing a listing.

We may suspend or restrict an account where we reasonably suspect fraud, impersonation, unauthorised access, abuse or a breach of these Terms.

6. Property-owner obligations

When submitting a property, you confirm that:

  • you own the property or have valid authority from the owner;

  • the listing does not violate another person’s rights;

  • all information supplied is truthful, accurate and not misleading;

  • the stated price, rent, deposit, service charges and other costs are accurate;

  • photographs and videos fairly represent the property;

  • you have permission to upload all submitted media;

  • the property can lawfully be advertised for the stated purpose;

  • you will promptly notify RAYLAV about material changes;

  • you will notify RAYLAV when a property is sold, rented, withdrawn or no longer available;

  • you will handle enquiries and viewings professionally and safely;

  • you will comply with applicable Kenyan laws and professional requirements.

You must not submit:

  • fraudulent, fictitious or misleading properties;

  • properties you are not authorised to advertise;

  • duplicate listings intended to manipulate search placement;

  • inaccurate prices designed to attract enquiries;

  • unlawful, discriminatory, defamatory or offensive content;

  • content that infringes intellectual-property or privacy rights;

  • malicious files, harmful links or code;

  • photographs containing personal information that should not be public;

  • listings connected to unlawful activity.

7. Submission, review and publication

Submitting a listing does not mean it will be published automatically.

RAYLAV may:

  • review submitted information and media;

  • request corrections, clarification or supporting evidence;

  • correct formatting, spelling or presentation;

  • select an appropriate category, tag or ribbon;

  • reject content that is incomplete, misleading, inappropriate or unlawful;

  • delay publication while a submission is reviewed;

  • remove or unpublish a listing where a concern arises.

Listings remain unpublished until approved by RAYLAV.

The listing period normally begins when the listing is approved and published, not necessarily when the form is submitted or the package is purchased.

An automatically generated Property ID is used for administration and identification. It is not proof of ownership, registration, title or legal status.

8. Listing packages, prices and duration

The available features, media limits, duration, search placement, price and other benefits of each listing package are displayed on the relevant package page or during checkout.

Package features may include:

  • a specified listing duration;

  • a maximum number of photographs;

  • video support where offered;

  • standard, priority or featured placement;

  • WhatsApp or contact enquiries;

  • viewing requests;

  • statistics or RAYLAV assistance.

Package placement improves eligibility for the stated visibility features but does not guarantee a particular number of views, enquiries, viewings, offers, tenants, buyers or completed transactions.

Prices are shown in Kenyan shillings unless stated otherwise. Applicable taxes and payment details will be displayed during checkout or on the invoice.

RAYLAV may change package prices or features for future purchases. Changes will not normally reduce a package that has already been purchased and activated, unless required by law, necessary for security or agreed with the customer.

9. Expiry, renewal and removal

Each listing is assigned an expiry date based on the purchased or agreed listing period.

When the expiry date is reached:

  • the listing may be unpublished automatically;

  • it will no longer be visible to ordinary marketplace visitors;

  • the owner may receive an expiry or renewal notice;

  • continued publication may require purchasing or approving a renewal.

Listings do not renew automatically unless checkout, the order confirmation or a separate agreement clearly identifies a recurring subscription and the customer has authorised recurring charges.

RAYLAV may offer renewal periods at the prices applicable when renewal is requested.

A listing may be removed before expiry if:

  • the property is sold, rented or withdrawn;

  • the advertiser requests removal;

  • the listing violates these Terms;

  • ownership or authority cannot be confirmed;

  • payment is reversed or remains outstanding;

  • continued publication creates legal, security or reputational risk.

10. Payments, cancellations and refunds

Payments for paid listing packages must be made using the payment methods offered through the Platform.

A successful payment does not override the listing-review process or guarantee publication.

If RAYLAV cannot publish a compliant paid listing for reasons attributable to RAYLAV, we may offer correction, replacement service, account credit or a refund, as appropriate and subject to applicable law.

Once a paid listing has been approved and published, listing fees are generally non-refundable where:

  • the owner changes their mind;

  • the property is sold or rented earlier than expected;

  • the owner withdraws the property;

  • the owner fails to provide complete or accurate information;

  • the listing is removed because of a breach of these Terms.

Nothing in this section removes or limits any mandatory consumer right or remedy available under Kenyan law.

Approved refunds will ordinarily be returned using the original payment method where reasonably possible. Processing times may depend on the payment provider or financial institution.

11. Enquiries and viewing requests

The Platform may allow visitors to:

  • send property enquiries;

  • request further information;

  • request or propose a viewing;

  • contact RAYLAV or an advertiser through email, telephone or WhatsApp;

  • save properties to a wishlist.

An enquiry or viewing request is not a confirmed appointment, offer, reservation, tenancy or sale.

The owner, advertiser or RAYLAV must separately confirm viewing arrangements.

Users are responsible for personal safety when arranging or attending viewings. Where appropriate, meet during reasonable hours, inform another person of your location and avoid carrying unnecessary cash.

RAYLAV may record enquiry and viewing information for administration, security, customer service and marketplace improvement.

12. User content and media licence

You retain ownership of content you submit, subject to any rights belonging to others.
